According to research, digital scams continue to grow significantly, reaching more than five million frauds in 2024. An increase of around 45%, according to the Association for the Protection of Personal Data and Consumers (ADDP).

Because of this new reality, it is not strange that different areas of society create alternatives to overcome this growing wave of digital violations. In the political sphere, the latest action that has gained public curiosity is PL 4.103/2024. But what it really is and what it aims to combat?Understand more with Branddi!

What is PL 4.103/2024?

PL 4.103/2024, authored by senator Ciro Nogueira, aims to establish new rules for the way advertisements are presented on digital commerce platforms. Therefore, through this control, the idea is that it will be possible to curb the high number of frauds that occur in these channels.

To this end, the PL makes changes to the Marco Civil da Internet, reinforcing that these direct sales must meet a series of requirements, such as:

Emphasizing that negotiation is carried out without intervention from the platform, only between users;

Easy and quick access to information and basic profile assessments of each user;

Provision of a channel insurance for reports and complaints;

Offer the buyer the seller's transaction history.

In short, the project reinforces the blamelessness of platforms in cases of transactions between users, encouraging those carried out through official channels.

Marco Civil da Internet: understand it better

In a nutshell, we can say that the Marco Internet Civil Law (Law No. 12,965/2014) is a Brazilian law that establishes the rights and duties of users and service providers in the digital environment.

To this end, it establishes a series of principles valid for the entire national territory, such as:

Net neutrality;

Accountability of providers;

Protection of users' privacy and personal data;

Regulation of content removal;

Connectivity as a fundamental right for digital inclusion.

How does this affect your brand?

Regardless of the existence of the Marco Civil or the approval of the new PL (which is currently awaiting submission to the Senate), one reality remains: the continuation of the growing wave of fraud does not only threaten your consumers, but also your business. This is because digital fraud can affect your brand in several ways, causing damage that goes far beyond the immediate loss of financial resources. After all, in addition to diverting traffic and conversions, these threats also impact the consumer experience, causing damage to reputation and a loss of trust among the end customer.

In other words, just waiting for reality to shape itself and guarantee the protection of your brand is not enough: you need to actively act against these infractions. Thus ensuring not only the safety of its consumers, but also the consolidation of its image in the market as a strong brand.
