According to research, digital scams continue to rise significantly, reaching over five million frauds in 2024. This is an increase of about 45%, according to the Personal Data and Consumer Protection Association (ADDP). Because of this new reality, it is not surprising that various sectors of society are creating alternatives to combat the growing wave of digital violations. What is PL 4.103/2024?

PL 4.103/2024, authored by Senator Ciro Nogueira, aims to establish new rules for how ads are presented on digital commerce platforms. Through this control, the idea is that it will be possible to curb the high number of frauds present on these channels. To achieve this, the bill makes changes to the Internet Civil Framework, reinforcing that direct sales must meet several requirements, such as:

  • Highlighting that the transaction is conducted without platform intervention, only between users;
  • Easy and quick access to basic information and user profile reviews;
  • Providing a secure channel for complaints and reports;
  • Offering buyers the seller's transaction history.

In summary, the project reinforces the non-liability of platforms in cases of transactions between users, promoting those conducted through official channels.

Internet Civil Framework: Understanding It Better

In simple terms, the Internet Civil Framework (Law No. 12,965/2014) is a Brazilian law that establishes the rights and duties of users and service providers in the digital space. It sets out a series of principles valid nationwide, such as:

  • Network neutrality;
  • Accountability of providers;
  • Protection of users' privacy and personal data;
  • Regulation of content removal;
  • Connectivity as a fundamental right for digital inclusion.
